Terms and conditions governing consulting engagements, diagnostic audits, and website usage with Think Harbor Base Co., Ltd.

Welcome to the website of Think Harbor Base Co., Ltd. (“Think Harbor Base,” “we,” “us,” or “our”). By accessing https://thinkharborbase.click or commissioning our engineering diagnostics, crash triage, or stability audit services, you agree to be legally bound by these Terms of Service.

1. Professional Services & Statements of Work

All specialized engineering engagements—including the Stability Diagnostic Audit, Crash Triage Retainer, Telemetry Pipeline Architecture, and ANR & Memory Profiling Sprint—are provided in accordance with these Terms and any mutually executed Statement of Work (SOW) or diagnostic brief. In the event of a conflict between these Terms and an executed SOW, the terms of the specific SOW shall take precedence.

2. Intellectual Property Rights

  • Client Proprietary Assets: All source code, symbol files (dSYM, ProGuard mappings), crash dumps, telemetry logs, and proprietary architectural documentation supplied by the client remain the sole and exclusive intellectual property of the client.
  • Consulting Deliverables: Upon full settlement of agreed diagnostic fees, the client is granted an irrevocable, perpetual, worldwide, royalty-free license to use, modify, and deploy all custom source code patches, test harnesses, and diagnostic reports produced during the engagement.
  • Think Harbor Base Tooling: Pre-existing diagnostic scripts, general analysis methodologies, and framework templates developed independently by Think Harbor Base remain our intellectual property.

3. Confidentiality & Non-Disclosure

We recognize the highly confidential nature of software crash data and source code. Think Harbor Base agrees to:

  1. Maintain strict confidentiality over all client diagnostic materials.
  2. Restrict access solely to assigned senior diagnostics engineers.
  3. Apply industry-standard cryptographic encryption during transit and storage.
  4. Securely purge all client artifacts upon conclusion of the engagement upon written request.

4. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Think Harbor Base provides diagnostic findings and code patches on a professional best-efforts engineering advisory basis.
  • Neither party shall be liable to the other for any indirect, incidental, special, or consequential damages, including loss of business revenue or goodwill.
  • The total aggregate liability of Think Harbor Base arising under any engagement shall not exceed the total fees paid by the client under the specific SOW giving rise to the claim.

5. Governing Law & Dispute Resolution

These Terms of Service and any contractual relationships arising hereunder shall be governed by and construed in accordance with the laws of the Kingdom of Thailand (TH), without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the competent courts of Thailand.
